Terms and Conditions

1. General information

These Terms and Conditions (the “Terms”) govern access to and use of the website purabelia.com (the “Website”) and the purchase of Pura Belia’s audio software products in plugin format (including Fragua, Yunque and Temple, hereinafter “the Products”).

The owner of the Website and the Products is Pura Belia (“Pura Belia”, “we”). Full identification details appear in the Legal Notice.

Accessing the Website and purchasing any Product imply full acceptance of these Terms. If you do not agree with them, please do not use the Website or purchase the Products.

2. The Products

The Products are audio instruments and effects that run as plugins (VST3, Audio Unit and/or Standalone formats) within a digital audio workstation (DAW) or standalone, depending on the Product.

The descriptions, features, screenshots and system requirements published on the Website are indicative. Pura Belia strives to keep the information accurate, but it may contain typographical errors or become outdated; we reserve the right to correct it at any time.

It is the user’s responsibility to verify that their system meets the published minimum requirements (operating system, compatible plugin format, etc.) before purchase. Where available, we recommend trying any demo version first.

3. Purchase, prices and payment platform

3.1. The Products are sold and distributed through Lemon Squeezy (Lemon Squeezy, LLC), acting as Merchant of Record. This means that, for the purposes of the transaction, Lemon Squeezy is the seller to the customer: it handles payment processing, invoicing, the application of the corresponding taxes (VAT or others) and the processing of refunds.

3.2. Prices shown on the Website and the checkout page are stated in the currency indicated in each case. Applicable taxes are calculated and shown at checkout by Lemon Squeezy based on your location.

3.3. Pura Belia reserves the right to change Product prices at any time. The price applicable to your purchase is the one in force at the time the order is placed.

3.4. After completing payment, you will receive a license key and/or a download link by email. It is the user’s responsibility to provide a valid email address.

4. License of use

4.1. Purchasing a Product does not constitute a sale of the software, but the grant of a license of use subject to the End User License Agreement (EULA) corresponding to each Product, which the user accepts upon installing or using it.

4.2. Unless the Product’s EULA provides otherwise, the license is personal, non-transferable and allows activation on a maximum of three (3) computers owned by or under the control of the user, for the exclusive use of the license holder.

4.3. The user may use the audio output generated by the Products in commercial and non-commercial works at no additional cost or restriction. The EULA details the conditions applicable to factory content (presets and other resources).

4.4. Resale, redistribution, lending, rental, sublicensing or making the Product or its license key available to third parties is prohibited, as is reverse engineering, except to the extent permitted by mandatory law.

5. Activation and license management

5.1. The Products require online activation by license key. During activation, the key and a machine fingerprint are transmitted to the validation service, in accordance with the Privacy Policy.

5.2. An internet connection is required at the time of activation. After successful activation, no connection is needed for normal use of the Product.

5.3. If you need to move an activation to a new computer, you may deactivate the Product on a previously activated computer and activate it on the new one. If you exceed the maximum number of activations, you must free up an existing activation or contact us for assistance.

6. Right of withdrawal and refunds

6.1. As these are digital content, and in accordance with EU consumer protection law, the withdrawal and refund conditions are detailed in the Refund Policy.

6.2. As Lemon Squeezy acts as Merchant of Record, refund requests are processed through Lemon Squeezy, without prejudice to the rights granted to consumers by law.

7. Updates

7.1. Minor updates within the same major version (for example, from 1.0 to 1.x) are provided free of charge to users with a valid license.

7.2. New major versions (for example, from 1.x to 2.0) may require a separate purchase, possibly at a reduced price for existing users, at Pura Belia’s discretion. Pura Belia is not obliged to provide updates or new versions.

8. Intellectual property

All intellectual and industrial property rights in the Products, the Website and their content belong to Pura Belia or its licensors. “Pura Belia”, “Fragua”, “Yunque” and “Temple” are trademarks of Pura Belia. Nothing in these Terms transfers ownership of such rights to the user. Third-party software incorporated into the Products is governed by its respective licenses, listed in the Third-Party Licenses document.

9. Acceptable use of the Website

The user undertakes to use the Website lawfully and not to carry out activities that may damage, overload, compromise the security of, or infringe the rights of third parties. Pura Belia may restrict access to any user who breaches these Terms.

10. Disclaimer of warranties and limitation of liability

10.1. The Products are provided “as is”, under the terms and warranty disclaimers detailed in each Product’s EULA.

10.2. To the maximum extent permitted by applicable law, Pura Belia shall not be liable for indirect, incidental or consequential damages arising from the use or inability to use the Products or the Website. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law, nor affects the mandatory rights granted to consumers by law.

11. Data protection and cookies

The processing of personal data is governed by the Privacy Policy and the use of cookies by the Cookie Policy.

12. Amendment of the Terms

Pura Belia may amend these Terms at any time. The version in force is the one published on the Website at the time of each purchase or use. Material changes will be reflected by updating the version number and date.

13. Governing law and dispute resolution

13.1. These Terms are governed by Spanish law.

13.2. For any dispute, the parties submit to the Courts of the city of Madrid (Spain), unless consumer law establishes a different mandatory jurisdiction.

13.3. If the user is a consumer resident in the European Union, they may use the EU online dispute resolution platform: https://ec.europa.eu/odr.
